FERPA Compliance

This policy is in extension of the Privacy Policy of Brahmarsive in compliance with FERPA requirements and applicable when such students’ personally identifiable information as available in educational records is procured by Brahmarsive from Educator for processing, storing, sharing, or using them. In such situations, Brahmarsive will abide by the following:
1. Access to your data:
A.
Brahmarsive will use commercially reasonable efforts to provide you access to your Personal Information (to the extent we are in possession of any) if you submit your request for access via an email to privacy@brahmarsive.com. Students who wish to access and modify their Personal Information must have the Educator (i.e., the Educational Agency or Institution as defined under FERPA) submit a request on their behalf or a student may logon to their account to review their end user data.
B.
Upon the Educator registering a Student Account, the Educator may access, modify or delete the Students’ information and any user generated content by selecting the areas of the site and information including End-User models, user generated content or user submissions.
2. Data breach statement:
A.
If Brahmarsive becomes aware of a systems security breach by an unauthorized party or that any user data was used for an unauthorized purpose, we will comply with relevant state and other data breach laws. We will notify users of any breach resulting in unauthorized release of data electronically, at minimum, and without unreasonable delay so that you can take appropriate steps. The notification will include: date of the breach, the types of information that were subject to the breach, general description of what occurred, and steps Brahmarsive is taking to address the breach.
3. Notifications:
A.
Change of Control: Over time, Brahmarsive may grow and reorganize. We may share your information, including personal information with affiliates such as a parent company, subsidiaries, joint venture partners or other companies that we control or that are under common control with us, in which case we will require those companies to agree to use your personal information in a way that is consistent with this Privacy Policy.
B.
In the event of a change to our organizations such that all or a portion of Brahmarsive or its assets are acquired by or merged with a third-party, or in any other situation where personal information that we have collected from users would be one of the assets transferred to or acquired by that third-party, this Privacy Policy will continue to apply to your information, and any acquirer would only be able to handle your personal information as per this policy (unless you give consent to a new policy). We will provide you with notice of an acquisition within thirty (30) days following the completion of such a transaction, by posting on our homepage and by email to your email address that you provided to us. If you do not consent to the use of your personal information by such a successor company, subject to applicable law, you may request its deletion from the company.
C.
In the unlikely event that Brahmarsive goes out of business, or files for bankruptcy, we will protect your personal information, and will not sell it to any third-party.
D.
We may revise our Privacy Policy from time to time. You can see when the last update was by looking at the “Last Updated” date at the top of this page. We won’t reduce your rights under this Privacy Policy without your explicit consent. If we make any significant changes, we’ll provide prominent notice by posting a notice on the Brahmarsive Service (i.e., Website) and notifying you by email (using the email address you provided) within 30 days before the change takes effect, so you can review and make sure you know about them.
E.
We encourage you to review this Privacy Policy from time to time, to stay informed about our collection, use, and disclosure of personal information through the Service and Brahmarsive. If you don’t agree with any changes to the Privacy Policy, you may terminate your account. By continuing to use the Service or the Brahmarsive after the revised Privacy Policy has become effective, you acknowledge that you accept and agree to the current version of the Privacy Policy.
4. FERPA/AB1584 statement:
Regarding FERPA and California AB 1584 (Buchanan) Privacy of Pupil Records: 3rd-Party Digital Storage & Education Software (Education Code section 49073.1), Brahmarsive will abide to the following:
A.
Student records obtained by Brahmarsive from an educational institution continue to be the property of and under the control of the educational institution. The educational institution retains full ownership rights to the personal information and education records it provides to Brahmarsive.
B.
Brahmarsive users may retain possession and control of all generated content upon use of the Service by Students.
C.
Brahmarsive will not use any information in a student record for any purpose other than those required or specifically permitted by the Brahmarsive Terms of Use and Privacy Policy.
D.
Parents, legal guardians, or eligible students may review personally identifiable information in the student’s records and correct erroneous information by contacting their educational institution. Additionally, Brahmarsive users may access, correct, update, or delete personal information in their profile by signing into Brahmarsive, accessing their Brahmarsive account, and making the appropriate changes.
E.
Brahmarsive is committed to maintaining the security and confidentiality of student records. Towards this end, we take the following actions: (a) we limit employee access to student data to only those employees with a need to such access to fulfill their job responsibilities; (b) we conduct background checks on our employees that may have access to student data; (c) we conduct regular employee privacy and data security training and education; and (e) we protect personal information with technical, contractual, administrative, and physical security safeguards in order to protect against unauthorized access, release or use.
F.
In the event of an unauthorized disclosure of a student’s records, Brahmarsive will (1) promptly notify Users unless specifically directed not to provide such notification by law enforcement officials. Notification shall identify: (i) the date and nature of the unauthorized use or disclosure; (ii) the Personal Data used or disclosed; (iii) general description of what occurred including who made the unauthorized use or received the unauthorized disclosure; (iv) what Brahmarsive has done or shall do to mitigate any effect of the unauthorized use or disclosure; (v) what corrective action Brahmarsive has taken or shall take to prevent future similar unauthorized use or disclosure; and (vi) who at Brahmarsive the User can contact. Brahmarsive will keep the User fully informed until the incident is resolved.
G.
Brahmarsive will delete or de-identify personal information when it is no longer needed, upon expiration or termination of our agreement with an educational institution with any deletion or de-identification to be completed according to the terms of our agreement with the educational institution, or at the direction or request of the educational institution.
H.
Brahmarsive agrees to work with educational institution to ensure compliance with FERPA and the Parties will ensure compliance by providing parents, legal guardians or eligible students with the ability to inspect and review student records and to correct any inaccuracies therein as described in statement above.
I.
Brahmarsive prohibits using personally identifiable information in student records to engage in targeted advertising.
